 The following information applies to any use of the Website by any user thereof and in general to all activities of Codeville and any contractual relationship with a customer, a potential customer and/or contact person of Codeville (hereinafter referred to as the "Data Subject").

BE 0789.730.052, tel.: +32(0)472790731, e-mail: contact@codeville-antwerp.com), which is the Data Controller of the personal data of the Data Subject.

 Codeville attaches great importance to the protection of privacy and processes the personal data provided to it with due care. Personal data are data which allow Codeville to identify a person as such. Codeville hereby informs you of the personal data that it processes. 

 Codeville reserves the right to modify this privacy statement without individual notice. Such changes will be announced on the Website each time. 

 The processing of personal data is subject to and done in accordance with the European Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) and the Act of 30 July 2018 on the Protection of Natural Persons with regard to the Processing of Personal Data.

 Codeville is free to choose a natural or legal person to process the personal data of the Data Subjects at its request and on its behalf (hereinafter referred to as the "Processor"). In that case, Codeville undertakes to select a Processor that provides sufficient guarantees to implement appropriate technical and organisational measures in such a manner that the processing will meet the requirements of the GDPR and ensure the protection of the rights of the Data Subject.

By using our Website, you accept that certain personal data are automatically collected and processed in accordance with the purposes described below.

 

2. Which categories of personal data are processed?

 

In order to realise and optimise its services, Codeville collects and processes the following personal data:

- Identity data,
- Contact details;
- Financial data;
- Technical data relating to the use of the Website, such as, among others, the IP address of the Data Subject, the date and time of his or her visit to the Website;
- Any information voluntarily communicated by the Data Subject.

 

3. Legal bases and purposes for processing of personal data

 

The personal data of the Data Subject is collected by Codeville on the legal bases set out below and for the following purposes:

 1) Necessary for the performance of the contract

 Codeville must process the aforementioned personal data of the Data Subject in the framework of its customer management, in particular so that it can send order confirmations, deliver and follow up the order(s), send and follow up invoicing, handle payments, provide after-sales services and for the management of any disputes. 

 Codeville also processes personal data in the context of its supplier management, in particular for supplier administration, order and payment management, supplier evaluation and prospecting. 

 

If you oppose the processing of your personal data, the agreement cannot be (further) executed. 

 

2) Legitimate interest of Codeville

 

Codeville may also process the aforementioned personal data of the Data Subject if it is in the legitimate interest of the company as is the case for the following purposes:

 

- For direct marketing purposes, such as sending information about the products and services offered by Codeville, about events organised by Codeville or in which Codeville participates, for the purpose of announcing promotions and/or formulating offers. The legitimate interest of Codeville concerns the freedom of enterprise. 

 

- To detect, prevent and combat fraud and abuse. The legitimate interest of Codeville is to curb fraud and abuse. 

 

- To develop and improve our products, services, communication methods and the functionality of our Website. The legitimate interest of Codeville concerns the improvement or further development of its services and business activities in general.

 

- In the context of IT management, infrastructure management and IT security. 

 

3) Legal obligation

 

Codeville also processes personal data to fulfil its legal and regulatory obligations, such as, for example, the fulfilment of tax obligations.

 

4) Permission

 

Codeville processes certain personal data on the basis of consent. For example, the Data Subject may decide to voluntarily disclose certain information to Codeville.

 

In such case, the Data Subject gives his/her consent to the processing of such personal data. 

 

If we process your data on the basis of your consent, you may withdraw it at any time. The withdrawal of consent does not affect the lawfulness of the previous processing based on the prior consent.

 

4. Data recipients 

 

Codeville wishes to protect your privacy as much as possible. To this end, Codeville takes appropriate technical and organisational measures to secure the personal data, including measures against unauthorised access, unauthorised use, unauthorised modification, unlawful and accidental destruction and accidental loss.

 

Personal data are only consulted or processed by employees of Codeville who must have access to them in view of their position. Employees of Codeville are subject to an obligation of confidentiality where applicable. 

 

If all or part of the processing of personal data by Codeville is outsourced to a third party, this shall be done pursuant to an appropriate processor's agreement that specifies the subject matter, duration, nature and purpose of the processing and agrees on the level of technical and organisational measures.

 

As part of the fulfilment of the purposes, we may communicate your personal data to: 

 

- Public authorities, when required by law or to the extent necessary for the establishment, exercise or substantiation of a legal claim;
- External service providers (such as accountants, ICT service providers, hosting service providers, communication agencies, CRM software suppliers).

 

5. Rights of the Data Subject

 

In accordance with current regulations, you have the following rights as a Data Subject:

 

- Right to access your personal data: you have the right to obtain confirmation about whether or not your Personal Data is being processed and, if so, to obtain access to your Personal Data and information regarding the processing.

 

- Right to rectification: you have the right to correct incorrect Personal Data, complete your Personal Data and have recipients to whom Personal Data was provided informed of the rectification.

 

- Right to erasure: subject to certain conditions, you have the right to have your Personal Data erased. If your Personal Data was made public, Codeville will take reasonable steps to inform the controllers who are processing the Personal Data of your request to erase it and to inform the recipients of Personal Data of your request to erase it.

 

- Right to restriction of processing: subject to certain conditions, you have the right to obtain restriction of the processing of your Personal Data, and, in case of restriction, have the processing limited to mere storage.

 

- Right to data portability: subject to certain conditions, you have the right to obtain the personal data processed by us in a structured, common and machine-readable form and/or to ask us to provide it to another controller.

 

- Right to withdraw your consent: the consent you have given us to process your personal data may be withdrawn by you at any time, without prejudice to the lawfulness of the processing before your consent is withdrawn.

 

- Right to object: you have a right to object to the processing of your personal data (1) necessary for our legitimate interests, but there are reasons specifically related to your situation and (2) for the purpose of direct marketing (in the latter case, you do not have to provide reasons). However, such opposition is not possible if the processing of your personal data is necessary for the performance of a contract.

 

- Right to logde a complaint: if you believe we have breached the GDPR, you always have the right to lodge a complaint with a supervisory authority. 6. Retention of personal data

 

Codeville processes and stores your personal data for as long as is necessary in function of the purposes of the processing. 

 

Legal retention periods have been established for certain personal data. Where appropriate, we retain personal data in accordance with these legal retention periods. 

 

Personal data processed in the context of a contractual relationship will be retained for a period of 10 years from the end of the contractual relationship.

 

Regarding the retention period of personal data collected when visiting our Website, please refer to our cookie statement. 

 

For all other purposes, the retention period is 2 years.
